Last updated: August 16, 2026
1. Agreement
By accessing bidandbid.com or creating an account, you agree to these Terms of Service, our Company Policy, and Privacy Policy. If you do not agree, do not use the platform.
2. Platform role
bidandbid.com operates an online marketplace connecting vehicle sellers and buyers in the United States. We are not a party to the sale contract between buyer and seller unless explicitly stated. All auctions are conducted in US dollars.
3. Bidding
Each bid is a binding offer to purchase at the bid amount plus the disclosed buyer’s premium. Bid increments are tiered by price. Qualifying last-second bids extend the auction (anti-sniping). Retracting a winning bid may result in suspension.
4. Title disclosure
Sellers must accurately disclose title brand (clean, salvage, rebuilt, flood, lemon/buyback). Misrepresentation is grounds for listing removal, transaction reversal, and account termination.
5. Fees
Buyer’s premium is disclosed before bid confirmation. Seller fees, if any, are shown at listing time. All fees are visible before commitment.
6. Payment Desk settlement
Winning buyers complete settlement through our Payment Desk (wire, ACH, or approved dealer terms). Invoices reference lot number and operator confirmation — not unattended card checkout.
7. Prohibited conduct
Shill bidding, bid manipulation, unauthorized automation against other bidders, vehicle misrepresentation, and fee circumvention are prohibited and may violate federal and state law. Violations result in termination.
8. Disputes
Buyers may open a dispute within the published window for material misrepresentation. Open disputes from your account page so they link to the auction record. The desk may hold settlement pending review.
9. Limitation of liability
To the maximum extent permitted by law, ${BRAND.name} is not liable for indirect, incidental, or consequential damages arising from use of the platform. Our aggregate liability is limited to fees paid to us in the twelve months before the claim.
10. Governing law
These Terms are governed by New York law. Disputes shall be resolved in New York County, New York, except where mandatory consumer law provides otherwise.
